Terms of Service – Sum Good Foods Inc.

Welcome to Sum Good Foods Inc. (“Sum Good”, “we”, “us”, or “our”). We operate this online store and website, including all related information, content, features, tools, products, and services (the “Services”), to provide you with a curated shopping experience. Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”) explain your rights and responsibilities when you use or access the Services. By visiting, browsing, or making a purchase through the Services, you agree to be bound by these Terms and by our Privacy Policy and Refund & Returns Policy. If you do not agree, you should not use or access the Services.

We work hard to describe and photograph our products as accurately as possible. However, colours, textures, and product appearance may vary slightly due to differences in devices, screens, and settings.

We do not guarantee that any product or service will meet your expectations, or that it will look exactly as displayed on your screen.

We may change product descriptions, ingredients, pricing, and availability at any time, without notice. We may discontinue products, or limit quantities to any person, household, or region, at our discretion.

3. Orders and purchases

When you place an order through the Services, you are making an offer to purchase the products in your cart. We reserve the right to accept or decline any order, in whole or in part, for any reason. Your order is not accepted until we process your payment and send an order confirmation.

Please review your order carefully before submitting it. Once an order has been accepted and moved into processing, we may not be able to cancel or change it. If we are unable to accept or must cancel your order, we will attempt to notify you using the email address or other contact details you provided at checkout.

All purchases are subject to our Refund & Returns Policy.

You represent and warrant that you are purchasing products for personal or household use only, and not for resale or export.

4. Prices, promotions, and billing

All prices are listed in the currency shown at checkout and are subject to change without notice. The price charged for a product will be the price in effect at the time your order is placed, and will be reflected in your order confirmation. Unless otherwise stated, prices do not include applicable taxes, shipping, handling, customs, or import charges.

Prices in our online store may differ from prices offered in other channels, including physical retailers or third‑party online platforms.

From time to time, we may run promotions or special offers. These may be subject to additional terms. If there is any conflict between the promotion terms and these Terms, the promotion terms will govern for that specific offer.

You agree to provide current, complete, and accurate purchase and account information, and to promptly update your details (including email address and payment information) so that we can complete your transactions and contact you as needed.
By submitting payment information, you represent and warrant that:
  • The payment information you provide is true, correct, and complete
  • You are authorized to use the payment method provided
  • Charges incurred by you will be honoured by your payment provider
  • You will pay all charges incurred at the posted prices, including taxes, shipping, and any applicable fees
5. Shipping and delivery
We currently ship only to the locations listed at checkout. Delivery estimates provided at checkout or in order confirmations are just that—estimates. They are not guaranteed.
Once we hand your order to the shipping carrier, title and risk of loss pass to you. We are not responsible for delays caused by carriers, customs, weather, or events outside our control. If your order arrives damaged or does not arrive, please contact us at info@sumgood.ca within a reasonable time and we will work with you to resolve the issue in line with our Refund & Returns Policy.
6. Intellectual property
All content and materials on or in the Services—including text, graphics, images, logos, product descriptions, videos, audio, designs, layouts, and the overall look and feel—are owned by Sum Good Foods Inc., our affiliates, or our licensors, and are protected by applicable intellectual property laws.
You may use the Services for your personal, non‑commercial use only. You may not copy, reproduce, modify, publish, distribute, create derivative works from, publicly display, or otherwise exploit any part of the Services or their content without our prior written permission.
Sum Good names, logos, product names, and slogans are trademarks of Sum Good Foods Inc. or its affiliates. Shopify’s name and logos are trademarks of Shopify Inc. All other names and logos appearing on the Services are the property of their respective owners. You may not use any trademarks without the prior written consent of the relevant rights holder.
7. Optional tools and features
From time to time, we may offer access to third‑party tools, apps, or features through the Services (for example, review widgets, payment providers, or subscription tools). These are provided “as is” and “as available” without any warranties or endorsements from us.
Your use of any optional third‑party tools is entirely at your own risk and subject to the terms and policies of those third parties. We are not responsible for any issues arising from or related to your use of third‑party tools.

If you access third‑party websites or purchase products or services from them, you do so at your own risk. Please review the third party’s own terms and policies carefully. Any complaints, questions, or claims about third‑party products or services should be directed to that third party.

Our store is hosted and powered by Shopify, which enables us to provide the Services. However, all sales and purchases you make through this store are between you and Sum Good Foods Inc., not Shopify.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of your purchases, including any injury, damage, or loss related to products or services you buy from us. You expressly release Shopify and its affiliates from any claims, damages, or liabilities arising out of or related to your transactions with Sum Good.

You are solely responsible for any Feedback you submit and for any consequences arising from it.

From time to time, there may be information on the Services that contains typographical errors, inaccuracies, or omissions (for example, relating to product descriptions, pricing, promotions, or availability).

Without limiting the foregoing, we do not represent or warrant that:

These Terms and any disputes arising out of or relating to the Services will be governed by the laws of the jurisdiction where Sum Good Foods Inc. is headquartered, without regard to its conflict‑of‑law provisions. You consent to the exclusive jurisdiction and venue of the courts in that jurisdiction.
